Frequently asked questions

Seller’s Agency in Fredericksburg Texas and the Texas Hill Country.

When you plan to sell your real estate, it is important to understand the process of listing your property. Real estate firms have an authorizing form called a ‘listing agreement’. This document outlines the responsibilities and obligations of the agent and the real estate brokerage firm as the representatives for your interest in the sale of your property. Below are some of things to expect your agent and broker to do:

• Advance your best interest at all times

• Demonstrate loyalty

• Respect and adhere to your legal instructions

• Make sure you have all material facts for decision making

• Make reasonable effort to use their skills

• Account for all funds in their care

• Keep you updated on matters regarding your real estate

One of the most important things to know regarding seller representation is that your agent, the brokerage firm and all authorized agents of that firm may not give any of your confidential information to any buyer’s agent and their clients. Unless you give permission otherwise, this is true for the entire duration of the real estate listing agreement. (An important note: prior to signing the listing agreement, it is important to not share anything you would not want a buyer to know. Make sure you have a legal relationship first.)

There are many services that you should expect from the listing firm such as:

• Give you accurate real estate market information to help you set the price of your property

• Provide advertising and marketing for your real estate

• Provide all required property disclosure forms for you to complete

• Work diligently in negotiations for the best possible price and terms.

• Go over all written offers with you

As you would expect, the real estate firm listing your property will require compensation in the form of a fee or commission. It is required that the listing agreement state the method for determining the fee or commission or state the exact percentage amount. It is also required that it state whether you give permission for the firm to share the commission with your buyer’s agent.
